Terms of Service

By accessing or using BEV ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use BEV. If you use BEV for a business, venue, or organization, you represent that you have authority to accept these Terms for that organization.

BEV is an 18+ social nightlife app. By using BEV, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• You will follow applicable laws, venue rules, and platform rules.
• You are responsible for complying with local alcohol, age, transportation, and safety laws.

To use BEV, you may need an account through a supported sign-in provider such as Google or Apple. You are responsible for:

• Providing accurate account information.
• Maintaining the security of your device and account.
• All activity that occurs under your account.
• Notifying us promptly of unauthorized access.

We may refuse, suspend, or terminate accounts to protect BEV, users, venues, or the public.

When using BEV, you agree not to:

• Harass, threaten, stalk, exploit, impersonate, or harm other people.
• Upload, post, or share illegal, explicit, violent, hateful, invasive, misleading, or otherwise unsafe content.
• Share photos, videos, reviews, messages, or other content you do not have the right to share.
• Create fake check-ins, fake accounts, fake venue information, spam, scams, or manipulative activity.
• Scrape, harvest, sell, or misuse user data, contacts, venue data, photos, or app content.
• Use contact or invite features to spam people or contact anyone who has not reasonably agreed to hear from you.
• Interfere with BEV, bypass security, reverse engineer private systems, or attempt unauthorized access.
• Use BEV for commercial, advertising, venue-owner, or automated purposes without our written consent.

BEV may display venue details, maps, photos, posts, events, links, social embeds, open data, and third-party provider data. This information may be incomplete, unavailable, delayed, or inaccurate. BEV does not endorse or guarantee any venue, provider, event, offer, or user recommendation.

Third-party services, app stores, sign-in providers, maps, venues, websites, and payment or reservation providers may have their own terms and privacy policies. You are responsible for reviewing and following those terms.

BEV uses location to provide discovery, maps, check-ins, friend-presence, personalization, and safety features. You can control location permissions in your device settings. Some features may not work without location access.

Your use of BEV is also governed by our Privacy Policy, which explains how we collect, use, share, retain, and protect information.

Some BEV access may happen through development, beta, preview, native, or other non-final builds. Those builds are for trusted testers and dev users; they are not storage vaults, safety systems, or proof that reality has perfect uptime.

• Experimental features and data may change, break, disappear, reset, or return incomplete results.
• You authorize BEV to use test data, diagnostics, feedback, and related submissions to build, debug, secure, support, operate, and improve BEV.
• Keep confidential, regulated, illegal, or third-party private information out of test builds unless you have the right to submit it and accept that BEV may use it for testing and development.
• Feedback, ideas, bug reports, and test results may be used by BEV without restriction or compensation.
• Non-public BEV features, builds, data, and technical behavior are confidential unless we make them public or give written permission.
• BEV may revoke test access, reset test accounts, remove data, disable features, or change testing requirements at any time.

BEV is evolving. We may add, modify, pause, limit, or remove features, venue data, rankings, access, or integrations at any time. We are not responsible for outages, app-store decisions, provider changes, network issues, or device limitations outside our reasonable control.

To the maximum extent permitted by law, BEV and its affiliates, owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, goodwill, venue losses, personal decisions, offline interactions, or other intangible losses arising from or related to BEV.

You agree to defend, indemnify, and hold harmless BEV from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of BEV, your User Content, your violation of these Terms, your violation of law, or your violation of someone else's rights.

We may suspend, limit, or terminate your account or access to BEV at any time if we believe it is needed to protect BEV, users, venues, the public, or our legal rights. You may stop using BEV at any time and may request account deletion as described in the Privacy Policy.

We may modify these Terms as BEV changes. We will post updated Terms in the app and update the last-updated date above. If changes are material, we may provide additional notice. Your continued use after changes become effective means you accept the updated Terms.

To the extent allowed by law, these Terms are governed by the laws of the United States and the state where BEV is operated, without regard to conflict-of-law rules. Consumer-protection and venue-related rights that cannot be waived still apply.

Before starting a formal dispute, you and BEV agree to try to resolve the issue informally by contacting bevvcool@gmail.com. Where permitted by law, disputes must be resolved individually and not as part of a class, collective, or representative action. Arbitration or small-claims procedures may apply where enforceable.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be limited or replaced to the maximum extent allowed by law.
